These Terms and Conditions govern access to and use of the online investment platform (the "EMD FINMART" & EMD MF) operated by [EMD FINMART PVT. LTD. ("Company", "we", "us", or "our"). By accessing, registering for, or using the Portal, you ("User", "Client", "you", "your") agree to comply with and be legally bound by these Terms.
Access & Eligibility new
You represent and warrant that: You are at least 18 years of age (or the age of majority in your jurisdiction). You have full legal capacity and authority to enter into these Terms. Your use of the Portal / Mobile App complies with all applicable laws and regulations. We reserve the right to refuse or revoke access at our sole discretion.
Services Offered
The Portal / Mobile App provides: Access to investment products and opportunities. Portfolio management and transaction capabilities. Performance reporting and account management tools. Communication channels with advisory and support teams. Nothing on the Portal / Mobile App constitutes personalized investment advice unless explicitly agreed under a separate advisory agreement.
Account Registration, Verification and Security
You must complete a full registration and verification process, including providing identification and financial information, to access full Portal / Mobile App functionalities. You must maintain the confidentiality of your login credentials. You must immediately notify us of any unauthorized use of your account.
We reserve the right to suspend or terminate access for violations of security or Terms.
Know Your Customer (KYC) Compliance
We strictly adhere to applicable KYC regulations. You agree to provide accurate, complete, and current information, including but not limited to identity documents, proof of address, and source of funds. We may verify your identity directly or through third-party service providers.
We reserve the right to freeze, suspend, or close accounts and report suspicious activities to regulatory authorities without prior notice.
Tax Compliance and Reporting
You are solely responsible for the reporting and payment of any taxes arising from your investments.
You acknowledge that we may be required to disclose account information to tax authorities under applicable laws (e.g., FATCA, CRS). You agree to provide necessary tax documentation as requested.
Electronic Communications Consent
By registering for the Portal / Mobile App, you consent to receive all communications, disclosures, and agreements electronically. Electronic communications may be provided via email, SMS, online notifications, or Portal / Mobile App messages. You agree that electronic signatures have the same legal effect as physical signatures.
Investment Risks
All investments carry risk, including the potential loss of principal. Investment values may fluctuate, and returns are not guaranteed. You acknowledge that investment decisions are made at your own risk.
Fees and Charges & Indemnification
Fees, commissions, and other charges will be disclosed prior to transactions. You authorize us to deduct applicable fees directly from your account(s) as per your client agreement. Fees are subject to change with prior notice.
Intellectual Property
All Portal / Mobile App content, materials, and technology are owned by the Company or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Portal / Mobile App for personal, non-commercial investment purposes.
Prohibited Activities
You agree not to:
Use the Portal / Mobile App for illegal, fraudulent, or unauthorized purposes. Disrupt or interfere with the security or functionality of the Portal / Mobile App. Engage in unauthorized data scraping, mining, or harvesting.
Disclaimers and Limitation of Liability
The Portal / Mobile App is provided on an "as-is" and "as-available" basis. We make no warranties regarding the accuracy, timeliness, completeness, or suitability of information provided. To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, or consequential losses arising from your use of the Portal / Mobile App.
Privacy and Data Protection
We collect, process, and store personal information in accordance with our [Privacy Policy]. We implement reasonable security measures but cannot guarantee absolute security.
Cancellation charges and Refund
A processing fee of Rs. 750 plus GST will be charged on each cancellation.
Refund of Partner Onboarding Fee;
Refund will be applicable only on valid cancellations
Refund method:
Refunds will be processed through the same payment method that was used to make the initial purchase.
Refund timeline:
Refunds will be processed within 7 business days from the date of the refund request.
Refund amount:
The refund amount will be equal to the original purchase price, minus any applicable fees or charges wherever applicable
Amendments to Terms and Conditions
We reserve the right to amend these terms and conditions at any time. Updated Terms will be posted on the Portal / Mobile App and become effective immediately. Continued use of the Portal / Mobile App after updates constitutes acceptance of the revised Terms.
Termination
You may terminate your account at any time by providing written notice. We may terminate or suspend your account immediately in case of breach, suspected unlawful activity, or regulatory requirement.
Governing Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of India.
Any dispute arises is subjected to the exclusive jurisdiction of the courts located in New Delhi.
